Under UK law everyone has rights in relation to personal data which may be held by other people or organisations. It is important that you are aware of your rights in relation to the information that I hold about you.
Personal data means any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.
You (or your solicitor) has asked me to provide legal advise or representation for you. I will need to hold information in order to contact you, for example sending emails, advising you on your claim, submitting information to the court or tribunal, replying to the other party in litigation and generally carrying out the terms of the instructions I am given.
I will need to hold information on you because it is necessary to perform the contract between us to provide legal advice or representation (or the solicitors who are acting for you) or because you have asked me to take specific steps before entering into the contract e.g. review documents in order to provide a quote.
In providing services I am also required to comply with certain legal obligations, I must for example ensure that I keep proper records of my practice for HMRC. I am also required to comply with anti-money laundering regulations and to report any suspicious activity.
I will also need to hold information to demonstrate that I have carried out the work that I was instructed to do and have provided advice on relevant matters.
The categories of information which I will collect will vary depending on the nature of the advice sought, but will include: name, date of birth, gender, contact details, employment details, information about your case or the matter you need advice on.
If the legal advice I am providing relates to allegations of discrimination or your health has been affected by the employment issues, I will have to keep ‘special category data,’ which is particularly sensitive information. This will include, depending on the circumstances of your case: race, ethnic origin, religion or belief, sexual orientation, disability, mental or psychological health and general health. It is necessary for me to hold this information on you to protect vital interests, to establish, exercise or defend legal claims. For example to properly advise you if the allegation is that you have been discriminated against because of your race.
Information will only be collected for these purposes and will not be used in a manner which is incompatible with those purposes. Your information will not be used for marketing or sold to others for that purpose.
It may be necessary to share your personal information with other members of your legal team, the court or tribunal, insurers, experts advising on your case, HMRC, other government agencies, debt collectors. In order to advance your case it may be necessary to provide information to the other party or to the court or tribunal.
Information collected will be limited to those purposes. Every endeavour will be made to ensure that the information is accurate and up to date. Every effort will be made to ensure that the information is kept safe and secure.
Information may be stored with Google and Evernote, and other platforms but will be subject to compliance with UK law.
You have a right to ask for details of the information held about you and can ask for a copy of it by making a relevant request in writing. If you make a request the information will normally be provided within 1 month. I may need to take steps to establish your identity if I receive a request. You can also ask for inaccurate information that I have to be rectified. You have a right to ask for the information that I have to be erased, but there may be some circumstances where the right to erasure does not apply depending on the facts of your case. You may also have a right to restrict or object to the processing of personal data, this might not apply to your case and depends on the circumstances.
Your information will be kept for 6 years after the conclusion of the case and then destroyed as soon as is reasonably practicable.
